The District of Massachusetts denied almost entirely the motions to dismiss brought by Zelis and its health insurance co-Defendants in an antitrust case alleging a horizontal conspiracy to reduce the payments to doctors who provide services to patients who are the insurance Defendants members. Despite Zelis’s bald and baseless claim in a press release that “the plaintiffs’ lawyers failed to conduct a diligent investigation before filing their claims,” the Court agreed with the viability of the allegations made in Plaintiffs’ 162-page complaint. “The complaint was one of the most thorough, well-researched complaints I have seen at this stage of an antitrust case,” said Jason Hartley, noting that it was filed before a single piece of evidence was developed in discovery. Plaintiffs look forward to vindicating their claims as the litigation continues.
