The lawsuit alleges a conspiracy of generic drug manufacturers to fix the price of generic drugs, resulting in a price surge in these important pharmaceuticals since March 2011. The scope of the alleged collusion encompasses myriad drugs and involves nearly every significant drug manufacturer in the United States, including Apotex, Breckenridge, Dr. Reddy’s, Glenmark, Heritage, Par, Lannett, Mylan and others.
The Antitrust Division of the U.S. Department of Justice continues a wide-ranging federal criminal investigation into the price-fixing conduct which has already resulted in criminal guilty pleas from pharmaceutical executives. Forty-five state attorneys general are pursuing the case as well. The case is In re Generic Pharmaceuticals Pricing Antitrust multi-district litigation pending in the Eastern District of Pennsylvania.
