SAN DIEGO (September 3, 2021): San Diego-based law firm Hartley LLP has filed a class action complaint against mobile communications company T-Mobile for failing to protect its customer’s personal data, which was obtained by hackers in a recent data breach, leaving millions of customers in peril.

The T-Mobile data breach occurred earlier this month and gave hackers access to personal identifying information including customers’ names, addresses, social security numbers, driver’s license information, phone numbers, dates of birth, security PINs, phone numbers, and, for some customers, credit card information as well. Because of the data breach, nearly all of T-Mobile’s customers are now at risk of having their identities stolen and other types of fraud.

“T-Mobile yet again failed to protect its customers and left them vulnerable to a variety of potential attacks from criminals,” said attorney Jason Hartley, Founder of Hartley LLP. “Customers should be able to trust that their cell phone company has adequate security practices and that their personal information is well-protected. T-Mobile has been the victim of several data breaches in the past and knew it needed to take better precautions to safeguard their data. The company’s negligence has put millions of people in danger, and they should be held accountable.”

This is at least the fifth data breach for T-Mobile in the last several years and its customers are susceptible to criminal behavior now and into the future. According to the complaint, T-Mobile’s inadequate security protocols also violate the California Consumers Privacy Act (CCPA).

Jason Hartley, along with co-counsel Jason Dennett and Kim Stephens of Washington-based law firm Tousley Brain Stephens PLLC, filed the complaint on August 31 on behalf of a nationwide class of all U.S. residents whose data was exfiltrated in the data breach and related to CCPA, a California class of residents whose data was exfiltrated.
